1. Acceptance of Terms

By registering for an account, purchasing campaign credits, deploying IVR systems, or using the Digitalnexk website, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you are not authorized to use our telecommunication services or marketing products.

We reserve the right to modify these Terms at any time. Updates will take effect immediately upon being posted on this URL. Continued use of our systems implies acceptance of the revised Terms.

2. Scope of Services

Digitalnexk is a cutting-edge telecommunications product company. We design, develop, and deliver next-level marketing solutions. The services offered include:

  • IVR (Interactive Voice Response): Setup and deployment of automated voice menus, professional recordings, call triage, routing rules, and unlimited recordings.
  • OBD (Outbound Voice Dialing): Automating pre-recorded call broadcast campaigns.
  • CRM Call Center Solutions: Integrations to track caller metrics, lead routing records, and agent activities.
  • Messaging services: Text SMS, WhatsApp API bulk distribution, and RCS (Rich Communication Services) marketing broadcasts.
  • Digital Solutions: Website design, maintenance, and search engine optimization (SEO) consulting.

3. Acceptable Use & Regulatory Compliance

Our tools are designed to facilitate communication. You agree to use these services in strict compliance with local and international laws, including the guidelines laid down by the Telecom Regulatory Authority of India (TRAI):

  • No Spam: You are prohibited from sending unsolicited bulk calls, SMS, WhatsApp broadcasts, or emails to recipients who have registered on the “Do Not Disturb” (DND) registry or have not opted-in to receive messages.
  • Content Guidelines: You may not transmit voice campaigns or messages containing abusive, threatening, fraudulent, politically sensitive, obscene, or copyright-infringing content.
  • Sender ID & Headers: You must register correct Header IDs and DLT (Distributed Ledger Technology) templates where applicable, and represent your entity transparently.

4. Billing & Fees

We offer flexible pricing options (monthly retainer, project-based packages, or retainer fees).

  • Fees: All fees are quoted in Indian Rupees (INR) unless indicated otherwise, and are exclusive of applicable GST taxes.
  • No Hidden Charges: We maintain complete transparency in our pricing models. Setups, voice-over fees, and bulk credit pricing are agreed upon explicitly before deployment.
  • Refund Policy: Prepaid credit purchases for SMS, IVR channel rentals, and voice dialing campaigns are non-refundable unless specified otherwise in a signed Service Level Agreement (SLA).

5. Intellectual Property

All software code, dashboards, website graphics, logos, DLT integration tools, and automation flow scripts developed by Digitalnexk belong exclusively to us or our licensors and are protected by copyright laws.

You are granted a non-transferable, revocable license to access our platform solely for your business administration. You may not copy, modify, reverse engineer, or distribute our platform's codebase.

6. Service Uptime Disclaimer

While we strive for maximum service availability (aiming for 99.9% uptime on our IVR servers and CRM tracking consoles), you acknowledge that telecommunication services depend on external partner gateways, telecom operator networks, internet backbone carriers, and API systems (such as WhatsApp APIs).

Digitalnexk does not guarantee uninterrupted services and is not liable for data loss or message delay caused by carrier gateway outages, network interruptions, or regulatory operator blocks.

7. Limitation of Liability

To the maximum extent permitted by law, Digitalnexk and its directors, agents, or employees will not be liable for any indirect, incidental, special, or consequential damages — including loss of profits, leads, business revenue, data corruption, or campaign costs — arising out of the use or inability to use our systems.

8. Termination of Accounts

We reserve the right to suspend or terminate your account access immediately and without prior notice if you violate TRAI guidelines, send spam broadcasts, engage in fraudulent activity, or fail to settle outstanding invoice payments.

9. Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the use of our services will be subject to the exclusive jurisdiction of the courts located in Mumbai, India.
